Prepare your renting file

The preparation of this file before starting your research will insure you a maximal reactivity towards the renting offer. Carefully prepare this file, he will be ask to you by all the owners.

We advise you to collect all the following documents:

  • A copy of your ID
  • Your certificate of registration to CAF, if needed
  • The last three salary certificate and your working contract
  • qYour last three certificate of renting
  • The certificate of your multirisk insurance for accomodation (for the rental agreement). You do not need it, for an accomodation which already has furnitures in it.
  • The commitment of one of your garants (if the owner asks for it)

One cannot ask you an ID pict, nor your social insurance card, nor your bank account details, nor certificate of a good on-going management of your bank account.

The rental agreement

The 6th of July 1989 law impose the writing of rental agreement written and signed by the renter and the owner.

Obligatories clauses

Some clauses cannot be avoid in your rental agreement:

  • Name and adress of the owner and of hif possible representant
  • The time of renting and the date you have been starting to rent it
  • A description of the accomodation and what belongs to it ( Cave, garage, garden,…)
  • The communal parts
  • The purpose of the rental: accomodation , professional use of it
  • The amount of the rent and the paiment form, and if it could revised
  • The amount the rental warranty: it is limited to 2 monthes without extra cahrges, and can neither be revised while the rental agreement is going on, nor when your reconduct it. If the rent can be paid all the three monthes, the owners can not ask you for a rental warranty.

Falcultative clauses

Owners and renters can agree on falcultative clauses. They can not be against the law. For example, the rental agreement can afford an extra delay of renting than the original minimal legal one.
The owners can ask for a garant (familly, employer…) to warranty the payment of the rent.

Other documents

The rental agreement have to be joined with these other documents:

  • Inspection check list
  • Rules of co-property
  • Certificate of multirisk insurance for the accommodation
  • Repartition of the charges between the owner and the renter
  • The Diagnostic of Energetic Performance
  • Natural and technological risks presence
  • The acommitment of a garant

Obligations of the renter

  • You have to pay the rent and the extra charges as the rental agreement stipulates it. Generaly, it is a monthly payment. If not, you can ask it to the owner.
  • In addition to the rent and the extra charges, you have to afford the rental reparing.
  • You have to use the accommodation in a peacefull way, espect what have been say in the rental agreement (for example the accommodation is only for personal used) and also the co-property rules.
  • You have to take an insurance to prevent you from the rental risks (Mainly, Water incident, fire, explosion, theft). One of the rental agreement clause can stipulate the annulation of the contract if you do not have this insurance.
  • Your are responsible for the deterioration and the loss that can happen while the rental agreement is going on, unless you proove their not directly your fault, the owner fault or someone else you did not invite.
  • You can not be against works of reparation or maintenance, or the ones in the commun places that needs to get through your accommodations.
  • You can not arrange your accommodation , or the furnitures, without the written agreement of the owner. If it is not the case, when you will leave, the owner can get benefits of these arangements without giving you something in exchange; he can also ask you to put it back in it initial way.
  • You can not pass or make some else rent your accommodation without the written agreement of the owner.

Inspection check list

It enables when you get in and get out to make the point on the state of the accommodation, and check out the responsabilities of the renter and the owner. A serious inspection check list is security fo the owner and the renter.take care to do it rightly.
The inspection check list has do be written, on a comon agreement, when taking and giving back the key. To be legal, the inspection check list has to be signed by both sides.

Notice for termination of a rental agreement

While the rental agreement is going on, only the renter can end the rent. The owner who wants to take back the accommodation can only do it at the end of the contract, unless the renter do not respect its obligations (payment of the rent, taking care of the accommodation, respect of the neighborhood).

The renter has to let know the owner about his will to move out of the accommodation 3 monthes before (In a formal letter). In some conditions, the delay can be reduce to 1 month (loss of his job, moving for professional or wealth reason). Even if the renter moves before the end of the notice for termination, he has to pay the rent and the extra charges until the time that was previously fixed. But he can avoid it if he finds an other renter to succeed him with the agreement of the owner.

The owner can have back his accommodation at the end of the notice for termination, in order to use it as his principal residence for him or his familly, or to sell it (however the renter has priority on it), or for a legal and serious reason.
The expiry date has to be given 6 month before the end of the rental agreement. The renter has to inform the owner with a formal letter.
Whatever is the reason given by the owner to stop the rental agreement, if the renter leaves before the end of the notice for termination, he only pays the rent and the extra charges corresponding at time he really stays in the accommodation.
